Our constitution is our country, without constitutionalism we have no country and can never be prosperous.

I am honestly tempted to demand that we move to have ANOTHER new constitution in Zimbabwe.

Honestly speaking this document which is said to have been a constitution by us and for us is just not serving its purpose.

The document was a compromise agreement by politicians who were all desperate to get into power and resultantly came up with an extremely flawed document.

In preparing the document, each of the political parties party to the process strongly believed that they were going to be the next government with a majority that was going to use its majority to manipulate the constitution to their advantage.

A lot of issues that could not be sealed in the debates (if not squabbles) making up the constitution were left hanging and sealed off by saying “an act of parliament will decide” obviously with each party believing that it will have the majority and push their own rejected agenda into the gap.

Make matters worse, the opposition parties pushed a lot of issues into the constitution that were clear targets to suppress specific ZANU PF behaviours obviously thinking ZANU PF was not going to make it back to power.

Now the same ZANU PF remained in power and retained a huge majority and are now taking advantage of the very closes that were left hanging or directed at them to manipulate the constitution.

It’s unbelievable that more than three years after the constitution was set up we still have over 70% of the statutes still not aligned to the constitution basically because of the lack of the political will power to even appreciate the very constitution let alone the need to align the statutes.

It’s so unfortunate that our politics tends to get so much influence into issues that need our sober minds for the benefit of the future of this country.

I have taken time again to go through some proposed constitutions that we did not adopt as a country. I have gone through the year 2000 Constitutional Commission draft, the NCA draft and the Kariba draft.

In all honest we had no reason rejecting the 2000 Constitutional Commission draft and going on to adopt this current empty document. The only reasons for both scenarios are non other than allowing some poorly timed politics to be of influence in our reasoning.

I know at this stage some somewhere will call my thinking crazy but mark my words the near future of this country will dump this constitution.

We can not be seen to be crafting statutes and administration policies of the country around individuals and personal egos as if those individuals will live forever.

This country does not only belong to the present but more importantly belongs to the future. Our lack of a belief in the future is even so clearly exhibited even by the young people in our ruling party who stand up and fight that President Mugabe who will be 94 at the next election remains their preferred candidate.

I strongly believe that all our issues in the country are as a result of lack of a basis and this basis being our constitution.

One Lovemore Madhuku got so carried away with hunger for power and destroyed the National Constitutional Assembly whose relevance could be more vital now in this era where the country is literally running without a constitution than when at least there was one albeit defined for us by colonial powers.

Don’t ask me, as I have always stated, I cast a NO vote at the referendum against all persuasions because I could never believe in a compromised document to be the supreme governing document for my country.
